Welcome to GALOXO. In these Terms of Service, "we", "us" and "our" refer to DASONS FL USA LLC, a company registered in Florida, United States, which owns and operates the GALOXO brand and the website at galoxo.store, including all related content, features, tools, products and services (the "Services"). GALOXO is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and account

By agreeing to these Terms you confirm that you are at least the age of majority in your state or country of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

To place an order you may be asked for information such as your email address, billing address, shipping address and payment details. You confirm that all information you provide is accurate, current and complete, and that you are entitled to provide it. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or assign your account to anyone else.

2. Our products

We make every effort to represent our products accurately. Colours and appearance may nevertheless differ from how they appear on your screen, depending on your device and its settings. We do not warrant that the appearance or quality of any product will match your expectations exactly.

Product descriptions and specifications may change at any time without notice. We may discontinue any product, and may limit the quantities we sell to any person, region or jurisdiction, at our discretion.

Age guidance and safe use. Our water painting books are made for children aged 1 and up and are independently tested to ASTM and CPSIA standards for children's products. As with any children's product, use is intended to take place with normal parental supervision. The water pen should be filled with clean tap water only.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion, and your order is not accepted until we confirm it. We must receive and process your payment before an order is accepted. Please review your order carefully before submitting it — once an order is dispatched we may be unable to change or cancel it. If we decline, change or cancel an order, we will try to contact you using the email address, billing address or phone number provided at the time of ordering.

Returns and exchanges are governed solely by our Return and Refund Policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price in effect when the order is placed, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include taxes, customs charges or import duties.

You agree to provide current, complete and accurate payment and account information for every purchase, and to keep it up to date. You confirm that (i) the payment details you provide are true and complete, (ii) you are authorised to use the payment method, and (iii) you will pay the amounts charged, including any shipping and applicable taxes.

5. Shipping and delivery

Shipping and delivery are governed by our Shipping Policy. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events outside our control. Title and risk of loss pass to you when the product is handed to the carrier, except where the optional Skip the Line insured shipping upgrade applies, or where the law provides otherwise.

6. Intellectual property

The Services, including all trademarks, brand names, text, images, graphics, video, audio and the design, selection and arrangement of them, are owned by DASONS FL USA LLC, its affiliates or its licensors, and are protected by United States and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. All rights not expressly granted here are reserved.

GALOXO, the GALOXO logo and our product names are trademarks of DASONS FL USA LLC. Shopify's name, logo and product names are trademarks of Shopify. All other names and marks appearing on the Services belong to their respective owners.

7. Third-party tools and links

The Services may give you access to tools and content provided by third parties, which we neither monitor nor control. These are provided "as is" and "as available", without warranties of any kind and without endorsement. Any use of them is at your own risk, and you should review the relevant third party's own terms. We are not responsible for the content or accuracy of third-party websites you reach from the Services, and complaints about third-party products or services should be directed to that third party.

8. Relationship with Shopify

GALOXO is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase you make is made directly with DASONS FL USA LLC. You acknowledge that Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage or loss resulting from products purchased, and you release Shopify and its affiliates from all claims arising from your purchases and transactions with us.

9. Privacy

All personal information collected through the Services is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your access to and use of the Services in order to provide and improve them. 10. Feedback and reviews

If you send us ideas, suggestions, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.

You confirm that you own or have the necessary rights to any Feedback you submit, that it does not infringe anyone's rights, and that it is not unlawful, abusive, defamatory or obscene. You may not use a false email address or impersonate anyone. We may, but are not obliged to, edit or remove Feedback that we consider objectionable or in breach of these Terms.

11. Errors, inaccuracies and omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such error and to change or update information, or cancel an order, at any time without prior notice, including after you have submitted your order.

12. Prohibited uses

You may use the Services for lawful purposes only. You may not use them: for any unlawful or malicious purpose; to violate any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send spam or unsolicited advertising; to impersonate any person or entity; or in any other way that restricts anyone's use of the Services or exposes us, Shopify or other users to liability.

You also agree not to upload viruses or malicious code, to reproduce or resell any part of the Services, to collect or track other people's personal information, or to interfere with or circumvent the security features of the Services. We may suspend or terminate access at any time if we determine that these terms have been breached.

13. Termination

We may terminate this agreement or your access to the Services at any time at our discretion and without notice, and you will remain liable for all amounts due up to the date of termination. The sections covering intellectual property, feedback, termination, disclaimer of warranties, limitation of liability, indemnification, severability, waiver, assignment and governing law survive termination.

14. Disclaimer of warranties

Information presented on the Services is provided for general information purposes only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS ANY RIGHT YOU HAVE UNDER MANDATORY CONSUMER PROTECTION LAW.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DASONS FL USA LLC, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

You agree to indemnify, defend and hold harmless DASONS FL USA LLC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or of the rights of a third party, or (3) your access to and use of the Services.

17. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed. This will not affect the validity of the remaining provisions.

18. Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of it. These Terms, together with any policies posted on the Services, constitute the entire agreement between you and us regarding your use of the Services, and supersede any prior agreements or communications.

19. Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign these Terms and our rights and obligations without notice to you.

20. Governing law

These Terms and any separate agreements under which we provide the Services are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. You and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida, except where mandatory consumer protection law in your country of residence provides otherwise.

21. Changes to these Terms

You can review the current version of these Terms on this page at any time. We may update, change or replace any part of them by posting an updated version here. It is your responsibility to check this page periodically. We will give notice of material changes as required by law, and your continued use of the Services after changes are posted constitutes acceptance of them.
